Mattel’s Fisher-Price brand that offers products and toys for children under 5 announced today that the company is recalling four different products which total more than 11 million units of toys and children’s products sold since the 1990s. The issues surrounding the recalls appear to be related to concerns arising following a variety of injuries, mishaps and safety issues.
The four products named in the recall include Fisher Price’s trikes, high chairs, toys with inflatable balls and another recalled product from the company’s Little People line.
Cut injuries to children is what led to the recalls of both the trike and high chair products. The most significant types of injuries have involved small girls who rode the trikes and had genital bleeding from colliding with a protruding plastic key. The Fisher Price high chair injuries were a result of the cuts and scrapes received from the parts or areas which were intended for tray storage.
In 2009, Fisher-Price paid a $2.3 million penalty for violating the federal government’s ban on lead paint. Two years prior to that, Fisher-Price paid approximately $1 million for failing to report more than 30 incidents involving one of its Little People toys.
Companies are required to report to the CPSC when they observe a defect that could cause injury or harm or receive reports from consumers that raise safety issues.
The Fisher Price recall as of 2:15 EST has not had much impact on the stock price of Mattel, Inc (MAT:NASDAQ GS).

A McMinnville, Tennessee resident that was admitted to a Vanderbilt University Medical Center in Nashville on Sunday is still in critical condition. Joey Evans, 27, was transported to Vanderbuilt Medical Center Sunday after being hit by a car while walking. The collision occurred at Rutherford Boulevard near Mercury Boulevard, according to a news release from Murfreesboro Police Department. Mr. Evans apparently walked into the path of a 2007 Nissan Altima driven by 24-year-old Alan Stewart, of Lebanon.
“MPD FACT (Fatal Accident Crash Team) investigators responded to Rutherford Boulevard near Mercury Boulevard,” said Murfreesboro Police spokesman Kyle Evans, via the department’s release. “Evans was transported to Middle Tennessee Medical Center by Rutherford County EMS and was later admitted to Vanderbilt with life threatening injuries.” This incident came just more than three days after a Murfreesboro woman was struck and killed by a vehicle on Northwest Broad Street.
Catherine A. Burns, 21, of Brinkley Avenue, was trying to cross Northwest Broad at Brinkley when she walked into the path of a car and was struck just after 7:50 p.m. last Wednesday. Deanna Ingram, 45, of Duluth, Ga., was driving her 2001 Hyundai when the vehicle she drove struck Burns. MPD’s FACT is still investigating the crash.

In recent years golf carts have become much more powerful and faster. Some golf carts manufactured today can reach top speeds of over 25 mph and have the power capacity to travel over 40 miles on one single battery charge. Over the past 5 years golf carts have becoming increasing more popular for use in transportation purposes at such as airports, sporting events, hospitals, airports, retirement communities, national parks, college campuses, airports and military bases. In a lot of apartment complexes, vacation properties and retirement communities, golf carts have become the primary means of transportation. Most golf carts are not subject to federal regulation, state and local regulations unlike most other motorized vehicles.
The number of golf cart related injuries have been significantly increasing each year. It is estimated that there were 5,772 cases in 1990 and then an estimated 13,411 cases in 2006, which is an increase of over 130%. The location of where the accident and injury was documented – the majority (70%) occurred at a sports or recreational facility. However, the most serious injuries occur on the street, often resulting in concussions, head injuries, broken arms, broken legs, broken collar bones and dislocations. These “off the golf course” accidents are more likely to require hospitalization.
Falling or jumping from a golf cart was the most common cause of injury for both adults and children (38.3%). However, children were at greater risk than adults for falls from a golf cart. Injuries caused by falls were more than twice as likely to result in injury to the head or neck, and more than six times more likely to result in concussion than injuries due to other causes.
According to investigator Lara B. McKenzie, Nationwide Children’s Hospital, Center for Injury Research and Policy, Columbus, OH, “Because golf carts are not designed for the safe transportation of children, their use for transporting children should be strongly discouraged….In addition, private and public facilities that allow golf cart use can help prevent cart–related injuries by requiring driver’s licenses and safety/operations training, establishing safety policies and considering golf cart safety in the design of pathways and landscapes. Given the large increase in golf cart–related injuries over the study period, greater efforts are needed to prevent these injuries, especially among children.”

Plaintiff Attorneys representing injured victims of the recalled Johnson & Johnson DePuy ASR hip implant are seeking to bring the lawsuits in to a consolidated multidistrict litigation. A motion filed on behalf of a woman who originally filed a Johnson & Johnson DePuy ASR hip implant lawsuit in California has made the consolidation request to the U.S. Judicial Panel on Multidistrict Litigation.
Johnson & Johnson recently recalled their DePuy ASR Hip Implant system after medical data collected from the National Joint Registry of England and Wales showed 12%-13% or approximately 1 out of 8 of those individuals who had received the recalled ACR devices were required to have a revision surgery within five years of receiving those implants. The ASR XL Acetabular System, which is a hip socket, and the ASR Hip Resurfacing System, a partial hip replacement that involves placing a metal cap on the ball of the femur are part of the recalled hip devices. The ASR XL Acetabular System is the only recalled hip implant that was approved in United States.
The symptoms of a potentially failing ASR hip implant may include an increase in pain or difficulty walking.
Patients who received one of the ACR hip implants are advised to call their surgeon and schedule a follow-up appointment, even if they are not experiencing symptoms or pain. The manufacturer may not maintain a list 0f the hip replacement implant patients, so patients who had the hip surgery after July 2003 are being advise to contact their surgeon or hospital to find out if there hip implant is part of this recall.
A multidistrict litigation (MDL) would allow all of the claimants that have or will file lawsuits against Johnson & Johnson DePuy in regards to the ASR recall lawsuit to be litigated under one federal judge for pretrial litigation. This is to prevent or avoid any duplicative discovery from being entered in as evidence, and to prevent inconsistent rulings from other federal judges. This MDL filing, if granted, will conserve some of the resources of each party such as expert witnesses, court costs, and court time.
If you have any questions about this hip implant recall or would like to see if you have a claim with this ACR Hip Implant Recall lawsuit, call the Tennessee attorneys of The Nahon Firm, PLC at (615) 324-2000 for a free consultation.
Tennessee State police are furthering their investigation of an early morning truck accident that injured two state troopers and closed the northbound lanes of I-95. Tennessee State Police from the Commercial Vehicle Unit are investigating two tractor-trailer trucks involved in a series of jackknife accidents along on Interstate-95 in Mamaroneck, Tennessee.
The commercial tractor trailer trucks are being checked for faulty braking systems and the other equipment to see if they were functioning properly prior to the interstate accident.
Two troopers were injured as they responded to the first semi-truck accident which resulted in a major pile-up. The troopers were not seriously injured and were taken to Sound Shore Medical Center by the Mamaroneck Ambulance Corps, where they were treated and released.
They were fortunate, as were the driver of the semi that first broke down across the highway at 4:04 a.m., and the driver of a 2011 Toyota stopped by that accident.
“The patrol car was demolished,” said State Police Sgt. John Antonelli.
The accident began when Rashad Pearson, 31, driving a 2011 FreightLiner out of Nashville, lost control on the rain-slicked highway. His truck flipped onto its side, sliding down the center lane. The incident halted Toyota, driven by 46-year-old Shao Chen of Elmhurst, NY, in the left lane. Then the responding troopers pulled up, to the right, in a marked 2007 Crown Victoria.
Driving a 1998 International, Scott Terry, 49, of Waterford NY, came upon the scene. His attempt to brake caused his semi to jackknife as well. The trailer slid across the northbound lanes and into the backs of all three vehicles. The highway was closed until nearly 7 a.m., police said.

Nashville, Tennessee – Golf carts are extremely dangerous motorized vehicles. As golf carts are becoming more commonly used in settings off the golf course, the total number of injuries is sharply rising. According to an article in the July 2008 issue of the American Journal of Preventive Medicine, from 1990 until 2006, the injury rate resulting from golf cart accidents rose over 130 percent. From 1990 to 2006, there have been approximately 150,000 golf cart-related injuries were recorded in people as young as 2 months and as old as 96 years.
September 23, 2010 – Two people in two days were killed after being thrown from golf carts in separate incidents at Beech Bend Park. Edie Phillips, 47, of Portland, Tenn., died at 5:22 p.m. Tuesday at Vanderbilt University Medical Center in Nashville and Henry D. Messer, 60, of Winchester, Ind., died at 11:21 p.m. Wednesday at The Medical Center. According to State Police, both victims were passengers on golf carts and were ejected, each receiving brain injury and head trauma resulting in their deaths. Phillips was a passenger on an E-Z Go golf cart and Messer was riding on a Harley-Davidson golf cart, according to the state police. Trooper Charles Swiney, KSP spokesman, said alcohol was a factor in both accidents and urged people operating and riding in golf carts at the park to do so responsibly.
Swiney said Phillips was sitting on the rear fender well of the golf cart and was thrown when the cart made a left turn. The cart had been modified so it sat higher off the ground than a standard golf cart, Swiney said. The accident involving Messer happened as the cart was traveling down a hill.
“(Messer) was standing up on the back and holding on to the roof as the cart was coming down the hill when the driver made a left turn,” Swiney said. “These were just two freaky accidents.”
Both accidents happened in the campground at Beech Bend, and the victims were thrown onto a paved area at the campground. Jones said he knew little about the accident involving Phillips, but was one of the first people at the scene after Messer was fatally injured. “I don’t know a whole lot, but apparently there were about three people standing on the back of this golf cart and he just lost his grip and fell backwards,” Jones said. Neither golf cart involved in the accidents belonged to the park, Jones said.

Crump, Tennessee – Hardin County Fire Districts 2 and 12 Emergency responders were dispatched to River Heights related to a three automobile accident that resulted in off-duty Sheriff Deputy Joe Pinson who was airliftrd from the scene. The initial accident report from the Hardin County Fire Chief indicated that a Ford Ranger, travelling westbound on HWY 64 broadsided the Pinson SUV on the passenger side, causing it to roll over on it’s side. The SUV was then pushed into a the third vehicle which sustained minimal amounts of damage.
Air-Evac landed in the Crump Park/ballfield in order to take Sheriff Deputy Pinson. The driver of the Ford Ranger was taken by ambulance to Hardin Medical Center. The Car/SUV accident is reportedly being investigated by the Crump Police Department and the Tennessee Highway Patrol. Eyewitnesses at the scene reported that the Ford Ranger, outfitted with “over-sized” tires and lifts, may have been operated without it’s headlights on. This has not been confirmed.

Proving liability is a significant challenge due to the serious injuries and high amount of coverage that is mandated by Tennessee state law. Tennessee truck accident claims are usually defended rigorously and this presents a unique set of challenges. When there is a tractor-trailor accident, both the driver of the commercial vehicle and the owner or company that owns the vehicle may also be held liable. In most Tennessee semi-truck accident cases, the driver usually does not own the truck and were hired by a trucking company to drive their vehicle. One common tactic used to defend the claim after a trucking accident, is for the truck driver and the trucking company may be liable but each party may argue their share of responsibility to reduce their financial liability to the injured or killed driver.
If you or a loved one has been involved in a truck accident, it is vital that you hire an attorney with experience in handling these types of cases. It is imparative that your attorney collects all the information about the driver’s driving record, hiring process, employment records and training of the company’s drivers. Most people that have been injured in a commercial truck accident do not fully understand the laws that are in place to protect victims of truck accidents. For example, tractor-trailer companies are required by federal law to carefully screen their drivers and their driving record. This screening process is not perfect and there are often cases where drivers have been errantly employed by a trucking corporation.
Another very serious issue that could be discovered during an investigation by one of our attorneys is whether or not the truck driver was under pressure to get their load delivered on or ahead of time. In order to increase profits, some trucking companies push their drivers or put them in dangerous conditions in order to get the load delivered. The Nahon Firm, PLC will ensure that your case receives the proper investigation of the accident to reveal or determine whether or not the trucking company created an unsafe condition which caused the accident. Our law firm, based in Nashville, TN, will also collect all of the accident reports and may hire reconstructionalists to help you prove liability against the trucking company.

A head-on collision south of Shelbyville on U.S. 231 late Monday afternoon killed the drivers of both vehicles. Samuel Prosser, 54, of Temple Ford Lane, and Stephanie Cameron, 37, of the Chestnut Ridge area, were dead at the scene after their vehicles collided about two miles from the city limits, Sgt. Monty Terry of the Tennessee Highway Patrol said.
The accident occurred about a half-mile south of the Snell Road-New Center Church Road intersection. The location is less than two miles from the school and occurred at about 4:30 p.m.
“The van (driven by Cameron) was southbound on 231,” Terry said. “The truck (driven by Prosser) was traveling northbound and came over into her lane and struck her head-on.” Drivers’ sides of both vehicles were smashed into the front seats. The reason Prosser veered across the center line is still undetermined but preliminary investigation found no signs of alcohol or drug use, Terry said. The accident is still under investigation..
