Suppose Jane ran a stop sign at an intersection and was hit by Tom’s car. Jane was at fault for not making sure the intersection was clear before proceeding. But suppose Tom was driving 10 miles per hour over the speed limit. In that case, the law would say both Tom and Jane were negligent. The complicated process is determining who is liable and entitled to compensation, and to what degree.
So what does “comparative negligence” mean when determining who is liable for a traffic accident?
Most states use this concept. The idea of “comparative negligence” is that each party is entitled to compensation based on the proportion to which they were negligent. If an injured person is partly at fault for the accident, their damages are reduced by the percentage of their fault. If Tom was determined to be 20 percent negligent for speeding through the intersection, then Tom would be entitled to only 80 percent of the damages. If an investigator or jury finds the total damages were $10,000 then Tom could only recover $8,000.
This is called “pure” comparative negligence, and is used in a minority of states. A majority of states use “modified” comparative negligence, in which a person cannot receive any damages if they were found to be more 51 percent at fault. Under this system, if Jane suffered a broken arm in the accident, she could not recover damages because she was more than 51 percent at fault. Some states set the bar at 50 percent instead of 51 percent.
