Roof Crush in a Rollover Accident

Wednesday, November 16th, 2011
The Insurance Institute for Highway Safety estimates that more than 10,000 people die each year as a result of a rollover crash, and further conclude that a large percentage of these deaths could have been prevented if the roofs of the vehicles had been made stronger. When a car rolls during an accident, the roof of the vehicle strikes the ground, crushing. Obviously, stronger roofs are less vulnerable to roof crush, which also greatly reduces the risk of the driver and passengers being killed or severely injured when the roof collapses. A vehicle roof which crushes easily, also leads to doors breaking or opening and windows and windshields breaking, meaning people have a higher chance of being ejected from the vehicle.

Some four decades ago the Federal Motor Vehicle Safety Standards required vehicle roofs to withstand a force at least 1.5 times that of the weight of the vehicle, in vehicles up to 6,000 pounds. Unfortunately, many SUVs and pickup trucks are substantially heavier than this weight, and are exempt from these crucial safety standards. 2005 found the government proposing that larger vehicles fall under the safety standards and that all passenger vehicles be required to withstand a force of at least 2.5 times that of their weight. This rule has not yet been adopted, and many believe it is still too low a standard to protect passengers in the event of a rollover accident.

Injuries Which Result From Roof Crush

Poorly designed or manufactured vehicle roof cause as many as 600 deaths and 900 injuries each and every year in the United States. The resulting injuries of a roof crush are usually very serious or even catastrophic, and can include the following: serious fractures, traumatic brain injury, severe head and neck injuries, paralysis and spinal cord injury. Any of these injuries will require hundreds of thousands of dollars in medical expenses and months or even years of rehabilitation. In many cases the injured person will never return to their previous way of life and will suffer from limitations, pain or total disability for the rest of their life.

SUVs and Rollover Accidents

Compared to typical passenger cars, SUVs are much more prone to rollover accidents because their center of gravity is much less stable. In fact, SUVs and pickup trucks are twice as likely to be involved in a rollover accident than a passenger car. Federal safety standards are urging manufacturers of SUVs to incorporate stronger middle sections in the roof area as well as a strengthened safety cage to protect occupants in the event of a rollover accident. Of course seatbelts should always be worn by occupants to hold them in place should a rollover occur.

You are Entitled to Compensation

Victims of roof crush are entitled to claim compensation, under the law, for injuries they sustain in a rollover accident which results in roof crush.  Vehicle manufacturers can be held liable for these injuries if the vehicle in question had a defect or was built with a substandard roof. The victim in a roof crush rollover accident is not required to prove negligence, but only to show proof that a component of their vehicle was clearly defective. If you’ve been injured in a roof crush accident, you should consult with a reputable attorney who specializes in injuries which result from roof crush rollover accidents. The roof of your vehicle should maintain its integrity during the rollover, with the support bars remaining intact, preventing the roof from caving in. If your vehicle’s roof did crush during your rollover accident, there was likely a design or manufacturing defect. Roof crush injuries require extensive legal knowledge, expertise and training, so if you or a loved one was injured as a result of rollover roof crush, contact an attorney immediately to protect your rights and advocate for what you need and deserve.

NHTSA Decision to Increase Roof Safety Standards Designed to Prevent SUV Rollover Fatalities

Thursday, June 30th, 2011

SUV rollover accidents have one of the highest fatality rates of all motor vehicle accidents.  A fundamental reason for the high fatality rate associated with SUV rollover accidents is the fact that most SUVs fail to meet minimum roof safety standards.  This lack of roof reinforcement means that when an SUV rolls over in a car accident the occupants often suffer roof crush injuries or are ejected from the vehicle as the vehicle is crushed.  SUVs that lack adequate roof strength have been a significant cause of catastrophic injuries and wrongful death in Tennessee SUV accidents for many years.  If you are seriously injured in a Tennessee SUV rollover accident or a loved one suffers wrongful death in a Tennessee SUV rollover accident, the experienced Tennessee SUV rollover accident attorneys at The Nahon Firm, PLC, will aggressively pursue your best interest in an effort to obtain the best possible outcome on your behalf.

SUVs are significantly more likely to be involved in a rollover accident than passenger vehicles.  Data from the U.S. Department of Transportation indicates that 84,000 people are injured in SUV rollovers and another 4,000 people are killed in SUV rollover accidents annually.  SUVs are involved in more than half of all vehicle rollover accidents every year and are three times more likely to rollover in an accident due to their inherent design than passenger vehicles.  Although SUV rollover accidents are less common than accidents involving pickups and passenger vehicles, single-vehicle rollover crashes account for nearly 50 percent of fatalities in SUVs compared with 36 percent of fatalities in pickups and 20 percent of deaths in passenger cars.  During a Tennessee SUV rollover accident, the impact of the roof with the ground causes the roof of the vehicle to deform and crush.  SUVs with more reinforcement of the roof reduce the risk that occupants will be killed or severely injured by an SUV’s collapsing roof.  An SUV with greater roof strength also reduces the risk of occupants being ejected through windows, windshields, or doors that have broken or opened because the roof of the vehicle has been deformed.  Stronger roofs keep SUV occupants inside the vehicle, which reduce both the frequency and severity of injuries. Because of the increased propensity of SUVs to rollover in a motor vehicle accident, the failure of auto manufacturers to meet minimum roof strength standards has placed many families at an extreme risk of suffering catastrophic injuries, such as serious head and neck injuries, traumatic brain injuries, spinal cord injuries, severe internal organ damage as well as fatalities.

When the roof of an SUV collides with the ground during an SUV rollover accident, the roof of the vehicle will tend to deform resulting in the roof being crushed and the passenger compartment of the vehicle collapsing much like a soda can when it is crushed under the weight of one’s foot.  If an SUV has more roof reinforcement, the seriousness of SUV occupant injuries can be decreased during a Tennessee SUV rollover accident because of the reduced risk of roof crush injuries.  Increased roof strength also decreases the probability of SUV occupants being ejected through windows, windshields, or doors that have broken or opened because the roof of the vehicle has been deformed.  SUV roofs that have been adequately reinforced help keep occupants inside the SUV where they are safer.

A recent report by the National Highway Traffic Safety Administration (NHTSA) that studied the impact of increased roof strength on SUV rollover fatality rates reached the conclusion that traffic safety experts have been promoting for years.  The NSTSA report concluded that stronger SUV roofs mean fewer catastrophic injuries and fatalities in SUV rollover accidents.  The NHTSA examined the degree SUV roofs were crushed into the passenger compartment of an SUV in actual SUV rollover accidents and found that SUVs with greater roof strength held up better.  This study follows the NHTSA’s decision last year to increase roof safety standards. The new NHTSA standards require SUVs to have a ratio of 1.5 times the weight of the vehicle.  The NHTSA projects that this increase will result in fewer fatalities and less catastrophic injuries including head, neck and spinal chord injuries.
